Update on TR Listing Agreement and Exempt Listings
We’ve receive several questions regarding whether Texas REALTORS® Listing Agreement (TXR-1101) satisfies the NAR disclosure requirements for utilizing a Delayed Marketing Exempt Listing.
Texas REALTORS® Listing Agreement (TXR-1101) does not satisfy the NAR disclosure requirement related to the use of Delayed Marketing Exempt Listings.
We previously proposed adding language to the listing agreement to address this issue and shared a draft for member input. The feedback emphasized that MLS exemption rules vary locally and that a uniform, statewide solution is not feasible.
While we do not plan to revise the listing agreement at this time, we are considering the possibility of providing a model form that local MLSs could use or adapt to meet their specific needs. That option remains under review. Please let us know if you have any questions or further input.
October Meetings Registration
An email will be sent on Friday, August 1 when registration for the Texas REALTORS® Party & Leadership Summit (formerly PAC/BOLC) opens. The event will again at the Kalahari on October 21-24. Since we offer two complimentary registrations for the Leadership Summit portion, you will be the primary contact for your association to register the total number of leadership positions you plan to bring (even if you haven’t had elections yet) during that time. Please do not plan to register members serving in the following positions as they will receive a unique link to register:
- RVP
- TREPAC Trustee
- Political Involvement Committee
- Legislative Management Team
- Public Policy Oversight Committee
- TRIP Local Issues Committee
Please contact our Meetings Department if you have any questions.
Litigation Update
Read more on how the judge rules in favor of NAR, Texas REALTORS®, and Wichita Falls Association of REALTORS®. Below are talking points from NAR for AEs to use regarding the MLS Access Cases (Eytalis) should the need arise.
- We are pleased with the Court’s decision confirming that Ms. Eytalis’ Complaint did not state a claim for a violation of any law.
- MLSs are operated at the local level and each MLS determines individual participation requirements.
- Membership in NAR has several benefits including:
- A nationwide advocacy platform that helps us achieve positive policy outcomes on issues that matter to the industry.
- A unified REALTOR® Code of Ethics that differentiates ourselves from non-REALTOR® professionals and builds trust with consumers.
- Resources and professional development that help our members build their businesses and advance their real estate careers.
- These are just a few of the benefits members enjoy.
