Disaster Relief Update
This week the Texas REALTORS® Executive Board approved a motion to:
- Convert the Texas REALTORS® Disaster Relief Funds into a single Foundation to make donations on behalf of local associations to local relief organizations to provide immediate aid to disaster-struck communities.
- Utilize NAR’s REALTOR® Relief Foundation (RRF) for housing assistance in the form of direct payments to affected Texas residents.
This means local associations will continue to have access to a fund for direct payment to residents whose housing is impacted by disasters and Texas REALTORS® will be able to provide immediate local assistance through local disaster aid charities. The updated program will be in place for the 2026 storm season. Please continue to work with Texas REALTORS® staff if your area is impacted by a disaster.
Update in Eytalis v. Wichita Falls, TR, & NAR
This was a suit brought by a member in federal court in which the member argued that NAR, Texas REALTORS®, and Wichita Falls Association of REALTORS® requires brokers:
- To join multiple associations to gain access to MLS services provided by the MLS, creating a “tying arrangement” in which access to MLS services, a separate product essential for real estate transactions, is conditioned on purchasing memberships to NAR, Texas REALTORS®, and Wichita Falls Association of REALTORS®; and
- To pay for nonmember sales persons.
This week the magistrate in that case recommended dismissing all claims without leave to amend. The recommendation now goes back to the federal judge for approval.
