Litigation Update
Good news on the litigation front. Defendants in the Texas litigation who are covered under NAR’s settlement, including Texas REALTORS®, filed a petition asking the court to grant a stay in the case. This would essentially allow the case to be put on hold until the settlement is finally approved.
Earlier this week the stay was granted by the court, so the Texas litigation will pause for now for those defendants. If the NAR settlement doesn’t go through and the parties are not otherwise able to resolve their issues, then the litigation will resume at the stage at which it was stayed.
Some local associations have been named in the Texas suit but have not been served. These parties are not included in the stay at this time, although at the point they are served they may ask to join the stay.
